The legal principle of a default judgment could apply to any secured loan, such as a car loan, where the asset seized by a defaulting debtor is sold for less than the lender still owes. In most cases, however, the term is associated with mortgage foreclosures. You may be able to negotiate a different repayment agreement with the lender or challenge the default judgment in court. Personal bankruptcy is another option, although it can have long-term consequences and should not be concluded without serious consideration of the pros and cons. A default judgment is a court order that allows a lender to collect additional money from a debtor who defaulted on a loan if the sale of the property that secured the loan is not sufficient to repay the entire debt. Default judgments are more common after mortgage foreclosures, although they are not allowed in all states. Mortgages are designed to avoid a gap by basing loan amounts on the estimated value of the property and requiring borrowers to make a down payment. It allows the lender to collect additional money from the debtor to make up the difference. Theoretically, these guarantees ensure that the lender can sell the property for enough money to recover its loan in the event of default by the borrower. But in a real estate downturn like the one that occurred in 2008, the value of a home can fall below the amount of the outstanding loan. This is sometimes called an underwater mortgage.
